Please read this agreement carefully. By downloading, installing, or using any product from Somerville Sounds, you agree to be bound by these terms.
1. Licence Grant
By purchasing a product from Somerville Sounds, a single user is granted a licence to use the software and included sounds in a musical context for commercial or non-commercial purposes without paying additional licence fees or royalties.
- Single Licence Use: Each licence is for a single user and cannot be shared between multiple users (e.g., in a shared studio or production house). Each user must purchase their own licence.
- Installation Limit: You may install the software on up to two computers, provided it is only used by the licensed user. For multi-user licences (e.g., schools or studios), please contact us for volume discounts.
- Restricted Use: The included sounds must be used as part of a musical composition. They must not be repackaged or sold as part of a new sample library, sound design library, or similar product without explicit written consent from Somerville Sounds.
2. Protection of Software
You agree to take reasonable steps to protect this software from unauthorized use or distribution. Somerville Sounds uses proprietary watermarking to track piracy. You agree not to decompile, decrypt, reverse-engineer, or otherwise modify the software to circumvent its protections.
3. Ownership
The software, included audio recordings, graphics, programming, presets, and all other intellectual property are licensed, not sold, to you. Ownership of all content remains with Somerville Sounds.
4. Prohibited Use in AI Training
- Prohibited AI Use: You may not use Somerville Sounds’ libraries or music created with them to train artificial intelligence (AI) systems or large language models (LLMs) without explicit written consent.
- Music Creation Only: The licence is exclusively for creating music and sound compositions. Any other use is prohibited unless agreed upon in writing.
- Enforcement: Somerville Sounds reserves the right to take legal action for any violations of this clause, including seeking damages and injunctive relief.
5. Refunds and Transfers
- Refunds: Due to the digital nature of our products, refunds cannot be issued once the files have been downloaded.
- Transparency: We provide detailed descriptions, product demos, and system requirements on our website to ensure you know what you are purchasing. If you have questions, please contact us before completing your purchase.
- Licence Transfers: Licences are non-transferable without prior written consent from Somerville Sounds. All libraries are individually watermarked with your details.
6. Taxes
Prices displayed on our website include applicable taxes (where required). Taxes will be calculated and displayed during checkout based on your location. For international purchases, additional taxes (e.g., GST) may apply and will be shown on the final checkout page.
7. System Requirements
Please ensure you meet all stated system requirements before purchasing. We are not responsible for compatibility issues resulting from unsupported systems.
8. Newsletter
When you place an order, your email address may be added to our mailing list. We use this list to share product news, updates, and exclusive discounts. You can unsubscribe at any time, though unsubscribing may prevent you from receiving updates for purchased products. We will never share your information with third parties.
9. Changes to this Agreement
Somerville Sounds may update these terms at any time without prior notice. Any changes will apply to all users from the date the updated terms are published on our website. By continuing to use our products or services after changes are posted, you agree to be bound by the revised terms.
10. Disclaimer
Somerville Sounds makes no guarantees regarding the suitability of its products for any particular purpose. All products are provided “as is,” and you assume all responsibility for their use.
